1. Agreement to these Terms

These Terms & Conditions ("Terms") govern your access to and use of WealthSimplicity.co (the "Site") and any digital products, downloads, courses, templates, guides, email content, and related materials we offer (collectively, the "Products"). The Site and Products are operated by [LEGAL NAME / REGISTERED ENTITY], trading as Wealth Simplicity ("Wealth Simplicity", "we", "us", "our"), based in South Africa.

By accessing the Site, subscribing to our email list, or purchasing a Product, you agree to be bound by these Terms, together with our Privacy Policy, Disclaimer, and Refund Policy, all of which are incorporated into these Terms by reference. If you do not agree, do not use the Site or purchase our Products.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase our Products or subscribe to our email list. By using the Site, you represent that you meet this requirement.

3. Products and purchases

Our Products are digital goods delivered electronically. Purchases are processed through third-party platforms, currently Gumroad and Whop, which act as the merchant and/or payment processor for the transaction. Your purchase is also subject to the terms of service and privacy policy of the platform through which you buy. We never receive or store your full payment card details.

Prices are displayed at checkout and may change at any time without notice. Price changes do not affect purchases already completed. Applicable taxes (such as VAT or sales tax) may be added at checkout by the platform, depending on your location.

4. License and permitted use

When you purchase a Product, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use that Product for your own personal, non-commercial education. You may not:

• share, resell, sublicense, rent, or redistribute any Product or your access to it;
• republish, reproduce, or publicly post any Product or substantial portion of it, whether free or paid;
• create derivative products, courses, or content for distribution based on our Products;
• remove or alter any copyright or proprietary notices.

Unauthorized use or distribution of our Products is a violation of these Terms and applicable intellectual property law, and may result in immediate revocation of access without refund, in addition to any other remedies available to us.

5. Intellectual property

All content on the Site and in the Products, including text, frameworks, systems, graphics, video, audio, design, and the Wealth Simplicity name and branding, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

6. Educational content only

All Site content and Products are provided for general educational and informational purposes only. Nothing we publish constitutes financial, investment, legal, tax, or accounting advice, and no advisory or client relationship is created by your use of the Site or purchase of a Product. Please read our Disclaimer, which forms part of these Terms, before acting on anything you learn from us.

7. Acceptable use

You agree not to use the Site or Products for any unlawful purpose; to interfere with the operation or security of the Site; to scrape, harvest, or collect data from the Site by automated means; or to misrepresent your affiliation with Wealth Simplicity.

8. Third-party platforms, links, and tools

The Site and our content reference and link to third-party platforms, tools, and services (including, without limitation, Gumroad, Whop, and Kit). We do not control and are not responsible for the content, availability, terms, or practices of any third party. Your use of any third-party service is at your own risk and subject to that party's terms. Some links may be affiliate links, as described in our Disclaimer.

9. Refunds

Refunds are handled in accordance with our Refund Policy. Nothing in these Terms limits any non-waivable rights you hold under the consumer protection laws of your jurisdiction.

10. Disclaimer of warranties

The Site and Products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any Product will produce any particular result or outcome for you.

11. Limitation of liability

To the maximum extent permitted by applicable law, Wealth Simplicity and its owner, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, savings, data, or business opportunity, arising out of or relating to your use of the Site or any Product, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to these Terms, the Site, or any Product will not exceed the amount you paid us for the Product giving rise to the claim in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Wealth Simplicity and its owner, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or Products.

13. Termination

We may suspend or terminate your access to the Site or any Product at any time, without notice, if you breach these Terms. Sections of these Terms that by their nature should survive termination (including Sections 4, 5, 10, 11, and 12) will survive.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Continued use of the Site or Products after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. Nothing in this section deprives you of the protection of mandatory consumer protection provisions of the law of the country in which you reside.
